Ali Muwanga Kibirige, heir to late Bulaimu Muwanga Kibirige (BMK) has lost a court of appeal case which he filed seeking reversal of a lower court decision which gave the bank authority to take over buildings with rental premises at Buziga, for failure to repay a sh1,506,200,000 loan.
The panel of judges including Cheborion Barishaki, Christopher Gashirabake and Dr. Asa Mugenyi of the court of appeal ruled that the appellant had skipped some steps and opened up cases in different high court branches which they classified as misleading and a delaying judgements in these courts.
For long, Muwanga has been battling to rescue family property which had been mortgaged by his brother Haruna Muwanga Kibirige, and procured huge amounts of money after the death of their father in 2021.

The heir and other family members claim that Haruna forged the deceased’s signature and mortgaged property titles without the family’s consent.
Dismissing Ali Muwanga Kibirige’s appeal, the judges noted that if he had followed the right steps since filing the appeal on April 13, 2024, he should have followed the right steps but sat behind and waited till after eleven months and woke up to the realization that his lawyers had done nothing.
He informed the court that when he filed his intention to appeal, he thought his lawyers had done whatever was required of them, not knowing that they had also simply sat behind and done nothing. In his appeal, he wanted the court to stop Yako Bank from taking over the buildings, but his appeal was dismissed and he was asked to pay costs to Yako Bank and his brother Haruna.
As it is, the court decision gives the bank authority to dispose off the buildings and recover its loan amount. In April 2024, Yako Bank took over ownership of the buildings at Buziga over a sh10bn loan. The buildings are on Block 273 Plot 46 on Mulambula Road in Buziga Hill View zone, Makindye Municipality.
