The prosecution alleges that Mabilizi referred to the Chief Justice as a conman, fraudster, and corrupt individual who allegedly sold property to bribe his way into judicial office—claims the State says are false and intended to ridicule and degrade him.
Jailed lawyer Hassan Male Mabilizi has been sent back to Luzira Prison for the second time, where he will remain until 6th March 2026 when a final ruling on his bail application will be delivered.
Mabilizi, who told court he has now spent 24 days on remand, appeared before the Buganda Road Court for the hearing of the State’s response to his bail application and his rejoinder.
Representing the State, Chief State Attorney Richard Birivumbuka from the Office of the Director of Public Prosecutions strongly opposed the temporary release. Birivumbuka argued that Mabilizi is a habitual offender who is capable of threatening witnesses and law enforcement officers through blackmail.

The prosecution further submitted that the charges stem from alleged misuse of social media platforms and warned that, if released on bail, Mabilizi could use the same channels to interfere with the ongoing trial.
Birivumbuka also contended that the accused has demonstrated what he described as “serial, continuous and repetitive disrespect” toward judicial officers, urging court not to grant him bail.
In his rejoinder, Mabilizi maintained his objection to the jurisdiction of Chief Magistrate Rita Neumbe Kidasa, insisting she should not preside over his case. He further argued that there is no specific law compelling him to respect judicial officers.
Mabilizi challenged the prosecution to present its witnesses if they are genuinely interested in testifying, rather than opposing his constitutional right to apply for bail and be tried while out of custody.
The Charges
On 3rd February 2026, Mabilizi was charged with malicious information and hate speech. He faces four counts alleging that in January 2026, while in various parts of Uganda including Kampala and Wakiso District, he used a computer to send and share information via his TikTok account (@male.mabilizi) that is said to have ridiculed and demeaned Dr. Flavian Zeija and Musa Ssekaana.

He is also accused of labelling Justice Ssekaana a conman and fraudster, statements the prosecution maintains are false and damaging.
Mabilizi has denied all the charges.
The court will deliver its ruling on his bail application on 6th March 2026, when he is expected to reappear before the Buganda Road Court.
