The Minister for Kampala Capital City and Metropolitan Affairs, Minsa Kabanda Nabbengo has scored a partial victory in the election petition challenging her victory as Kampala Central Division Member of Parliament after the High Court struck out 97 affidavits filed by her challenger, David Lewis Rubongoya.
The affidavits were expunged from the court record after Justice Nabakooza K. Flavia found that they had been filed as supplementary evidence without obtaining the court’s leave.
The ruling, delivered on October 7, 2026, arose from two applications filed by Kabanda and the Electoral Commission seeking to strike out the affidavits and other matters raised by Rubongoya in his petition.
Kabanda had also asked court to strike out challenges relating to her nomination, academic qualifications, differences in her names and the location of some polling stations.

However, the court rejected her argument that the challenges concerning her nomination, academic qualifications and names were matters that should have been raised before the election.
Justice Nabakooza held that the certified documents relied upon in relation to those issues were only issued on February 26, 2026, after the January 15 election. The court therefore allowed those grounds to remain part of the petition.
The judge, however, agreed with Kabanda that the complaint concerning polling stations allegedly located in restricted security areas was a pre-election matter that should have been raised before the election.
That ground was consequently struck out.
The court also found that the 97 affidavits filed by Rubongoya after the petition and responses had been filed were supplementary in nature and required the court’s permission.

Since no such leave had been obtained, the affidavits were declared irregularly filed and ordered struck out and expunged from the record.
The court subsequently closed the pleadings and directed that Rubongoya’s petition proceeds on the evidence and pleadings properly on record before it is fixed for a scheduling conference.
The consolidated applications by Kabanda and the Electoral Commission were therefore allowed in part, with costs to be in the cause.
Kabanda was declared and returned as the elected Kampala Central Division MP following the January 15, 2026 parliamentary election, which is the subject of Rubongoya’s petition.
