A state attorney at the Office of the Director of Public Prosecutions (ODPP) has been convicted over receiving a gratification of sh200,000 from two complainants.
The Anti-Corruption Court in Nakasero in Kampala, presided over by Grade One Magistrate Esther Asiimwe, on October 13, 2023, convicted Simon Kigwana of charges of corruption.
Kigwana was charged with corruption under Sections 2(a) and 26 of the Anti- Corruption Act.
It was alleged that Kigwana while employed as a state prosecutor at Nabweru Chief Magistrate’s Court in Wakiso district, directly solicited for gratification of sh6000,000 from Zam Ndagire and Octavious Kasumba.
In the second count, the prosecution said Kigwana on May 15, 2019, at Nabweru Play Ground, accepted a gratification of sh200,000 from Ndagire.
Court document indicates that Ndagire and Kasumba were complanants in criminal case number 368 of 2019, which was being prosecuted by Kigwana.
While delivering the judgment, Magistrate Asiimwe said the prosecution had proved that Kigwana received the money.
“Therefore, having found that the prosecution proved all the ingredients of this offence, I find the accused guilty of corruption as charged under count two,” Asiimwe said.
Asiimwe said she will deliver the sentence on October 18, 2023. Kigwana was sent to Luzira prison awaiting the sentence.
